Just nine days before Pathaan, the eagerly anticipated action movie featuring Shah Rukh Khan, Deepika Padukone and John Abraham, was due to be released in theatres, the Delhi High Court on Monday instructed Yash Raj Films to make some adjustments for its online streaming premiere on Prime Video on April 25. Although the Central Board of Film Certification had already given its approval to the film, it will now have to be re-examined by the CBFC prior to its OTT debut.

The court noted that it was too close to the theatrical release of Pathaan on January 25 to order audio description and other measures for the movie’s theatrical release. However, the court directed that, for the film’s release on Prime Video in April, the CBFC should re-certify it by March 10 after the producer adds subtitles.

Regarding the OTT release of ‘Pathaan’, the court instructed the producer to provide audio description, subtitles in Hindi, and closed captions to the CBFC for approval. After the submission, the CBFC will re-examine the film together with the subtitles, audio description, and closed captioning in Hindi.

Justice Prathiba Singh, of a single-judge bench, noted the significance of a plea advocating for the right of visually and hearing impaired persons to access films as per the Rights of Persons with Disabilities Act 2016. In accordance with Section 42 of the Act, the government must take steps to ensure that all content is made available to people with disabilities in an accessible format. Especially with films, special measures must be taken to provide the same experience to hearing and visually impaired persons as those without disabilities.
