Harvey Weinstein submitted a plea in the New York High State Court in Manhattan against the first-degree felony charge at a hearing before Justice Curtis Farber in a New York State Court in Manhattan.

Jurors had found Weinstein guilty of rape and sexual misconduct in 2020 but in the year 2024, the New York high court of Appeal overturned Weinstein's chargesof rape with 23-year sentence judges said in their verdict that he didn’t give a fair trial in his case because women who testify against him were not legally complaining in a court of law against the sexual misconduct crime.

Weinstein has denied having non-consensual sexual encounters with anyone. He pleaded in court not guilty on Wednesday to a new charge of forcing oral sex on a woman in a Manhattan hotel in the spring of 2006.

His Lawyer Arthur Aidala said to his client wants to go to trial but it was unfair for prosecutors to seek additional charges after Weinstein’s conviction was overturned.

A retrial had been tentatively set for Nov 12 but prosecutors claim that the charges are too much and required and they would likely to combined until January.

Harvey Weinstein remains in custody for separate charges of 2013 for Los Angeles and sentenced to 16 years in prison.

The Weinstein sexual crime charges began after the “Me Too Movement” that started the bizarre claim against the media mogul. He was sentenced to prison on two separate charges one in a  New York Court where he was sentenced to 23 years, and the second in Los Angeles where he was sentenced to 16 years.

But in recent years the New York Court of Appeal ordered a new trial and overturned his 23-year sentence saying the trial was unfair. The judges claim the new trial tentatively happened on 2nd October. The trial will tentatively open in November this year but is likely to be delayed.
