IndiGo Sues Mahindra for Trademark infringement Airline Objects to ‘6E’ in Electric Car ‘BE 6E’

Inter Globe Aviation, the company that works IndiGo, has filed a case against car producer Mahindra Electric Automobile Ltd. IndiGo has charged the company of trademark encroachment over the use of ‘6E’ in its recently launched electric car ‘Mahindra BE 6E’.

The matter was presented some time recently Equity Amit Bansal in the Delhi Tall Court on Tuesday (3 December 2024), but he recused himself from it. The case may be listened on 9 December.

Mahindra Electric said in an official statement, ‘We do not see any strife in our branding as the company’s mark is ‘BE 6e’ and not a single ‘6E’. This is distinctive from IndiGo’s ‘6E’, which represents an airline. There is no scope for perplexity. Too, the distinctive styling of the two shows their contrasts. Mahindra is in discourses with IndiGo to find an amicable solution.’

IndiGo works beneath the call sign ‘6E’, which shapes the premise of its branding and passenger services. Under this, the airline offers products such as 6E Prime (seat selection, priority check-in and snacks), 6E Flex (flexible rescheduling and cancellation) and additional 6E-branded services.

This includes extra baggage options and lounge access. The airline had registered ‘6E Link’ in several trademark categories in 2015. In this, it can use 6E in the services provided under Class-9, Class-16, Class-35 and Class-39.

On November 25, Mahindra Electric recorded an application with the trademark registrar to register the ‘BE 6E’ mark beneath Class 12. Once registered in Class-12, Mahindra will get the right to utilize the ‘6E’ assignment for electric and combustion engine vehicles, but two-wheelers.

Mahindra & Mahindra launched two ‘born electric’ SUVs, XEV 9e and BE 6e, in the Indian market on November 26. The company has manufactured both the electric SUVs beneath the pennant of its sub-brands XEV and BE. They are planned on Mahindra’s in-house INGLO platform, a secluded skateboard architecture particularly designed for electric vehicles.

The BE 6e Pack One starts at Rs 18.90 lakh ex-showroom, while the XEV 9e Pack One will cost you Rs 21.90 lakh ex-showroom. Both models are set to hit the market in January 2025. Delivery will start from February 2025. The company claims that both the cars will get a range of over 500 km on a full charge and will be able to accelerate from 0-100kmph in just 6.7 seconds.
